01
Beta status and acceptance
These terms apply to game discovery and play and to accounts, the creator dashboard, editor, AI assistance, preview, review, and publication in the MUTA public beta.
By creating an account or using a beta feature, you acknowledge these terms and the Privacy Notice. If you do not agree, do not use account or creator features.
02
Eligibility and minors
You must provide accurate account information, safeguard your account, and not use another person's account or share access credentials.
The current beta does not have a verified parental-consent flow for children under 14. Children under 14 may not create an account or upload content. Other minors must follow the law and guardian requirements where they live.
03
Free beta and commercial features
The public beta is free and does not provide real payments, paid subscriptions, product purchases, creator settlements, confirmed earnings, or cash withdrawals. Sandbox transactions, projected revenue, credits, or in-game values shown in the interface are test data and are not cash, property rights, or refund entitlements.
Commercial features will be enabled only after separate terms, pricing, refund and settlement rules, and required consent flows are ready.
04
Accounts and beta access
For stability and safety, MUTA may cap registrations, creator invitations, AI requests, and the number of publishable games. MUTA may request additional verification or temporarily restrict access when abnormal use is suspected.
Report a suspected account-security incident immediately to muta@emotionwave.com.
05
Creator content and license
You retain rights in your original creations. You must have the right to upload all content and the third-party permissions needed to run the game.
You grant MUTA a non-exclusive license to store, reproduce, technically adapt, transmit, display, and back up your content only as needed to operate the service and honor your publication settings. After unpublishing or deletion, that license ends except for a limited period required for backups, security, or legal retention.
Permission to play another user's game does not grant permission to copy or resell its source, characters, music, or other content.
06
AI-assisted features
AI may generate code, explanations, or proposed changes, but MUTA does not guarantee accuracy, security, completeness, or originality. Review code before applying it and personally play-test a game before publication.
Prompts and selected project context may be processed by a configured model provider. Do not submit passwords, API keys, personal data, or material you have no right to disclose. Requests may be rejected, canceled, or routed to another allowed model because of usage limits, provider failure, or safety needs.
07
Open source and third-party materials
Templates or sample games may include MIT, Apache, or other open-source components. Their accompanying LICENSE and NOTICE files and original-author conditions continue to govern those components.
Providing a sample runtime does not mean MUTA owns or can relicense third-party images, characters, music, or trademarks. Check each game's notices and asset licenses and replace assets where necessary with your own or properly generated or licensed assets.
08
Prohibited conduct
You must not:
- Create or distribute illegal, fraudulent, harassing, hateful, sexually exploitative, or unsafe content
- Infringe copyright, trademark, publicity, privacy, or other third-party rights
- Deploy malware, phishing, secret theft, unauthorized tracking, or attacks on devices or accounts
- Bypass access controls or limits, exploit vulnerabilities, overload systems, or disrupt the service
- Sell or misrepresent test currency, scores, or projected earnings as having real value
09
Review, publication, and takedown
Publication is not automatic and may require administrator review during the beta. MUTA may reject, unpublish, quarantine, or remove a game for legal, security, rights, quality, or operational reasons.
A rights complaint should identify the game, basis of the right, and usable contact information. MUTA may request supporting information or share the complaint with the relevant user where appropriate.
10
Service changes, suspension, and rollback
The beta is under active development. Features, models, game availability, and limits may change without advance notice or be suspended during incident response. MUTA may roll back to an earlier release for stability, and recent saves, AI jobs, or temporary data may not be recoverable.
MUTA uses reasonable backup and recovery measures but does not promise permanent retention or uninterrupted beta operation. Keep a separate copy of important game source and original assets.
11
Beta quality and responsibility
The service is provided for testing in its current state. MUTA does not guarantee uninterrupted operation on every device or browser, commercial suitability of a game, fitness of AI output, or continued availability of third-party services.
To the extent allowed by applicable law, each party's responsibility may be limited for outages outside its control or indirect losses. Nothing here limits non-waivable user rights or liability for MUTA's willful misconduct or gross negligence.
12
Stopping use and termination
You may unpublish a game and request deletion of an account or project. MUTA may restrict content or account access for a violation, security risk, or legal requirement and will explain the reason and available review process where practicable.
After account termination, data is handled under the Privacy Notice and applicable retention duties.
13
Updates to these terms
MUTA will update the version and date when the beta scope or operating terms change. Material changes to user rights or duties will be announced before they apply where practicable, and renewed consent will be requested when required.
Mandatory local law and consumer rights take priority over inconsistent parts of these terms.
